Przez osob\u0119 fizyczn\u0105 nale\u017cy rozumie\u0107 mi\u0119dzy innymi:<\/p><ol><li>pracownika,<\/li><li>pracownika tymczasowego,<\/li><li>osob\u0119 \u015bwiadcz\u0105c\u0105 prac\u0119 na innej podstawie ni\u017c stosunek pracy, w tym na podstawie umowy cywilnoprawnej,<\/li><li>przedsi\u0119biorc\u0119,<\/li><li>akcjonariusza lub wsp\u00f3lnika,<\/li><li>cz\u0142onka organu osoby prawnej lub jednostki organizacyjnej nieposiadaj\u0105cej osobowo\u015bci prawnej,<\/li><li>osob\u0119 \u015bwiadcz\u0105c\u0105 prac\u0119 pod nadzorem i kierownictwem wykonawcy, podwykonawcy lub dostawcy, w tym na podstawie umowy cywilnoprawnej,<\/li><li>sta\u017cyst\u0119,<\/li><li>wolontariusza,<\/li><li>praktykanta,<\/li><li>funkcjonariusza, w rozumieniu art. 1 ust. 1 ustawy z dnia 18 lutego 1994 r. o zaopatrzeniu emerytalnym funkcjonariuszy Policji, Agencji Bezpiecze\u0144stwa Wewn\u0119trznego, Agencji Wywiadu, S\u0142u\u017cby Kontrwywiadu Wojskowego, S\u0142u\u017cby Wywiadu Wojskowego, Centralnego Biura Antykorupcyjnego, Stra\u017cy Granicznej, Stra\u017cy Marsza\u0142kowskiej, S\u0142u\u017cby Ochrony Pa\u0144stwa, Pa\u0144stwowej Stra\u017cy Po\u017carnej, S\u0142u\u017cby Celno-Skarbowej i S\u0142u\u017cby Wi\u0119ziennej oraz ich rodzin (Dz. U. z 2023 r. poz. 1280, 1429 i 1834),<\/li><li>\u017co\u0142nierza w rozumieniu art. 2 pkt 39 ustawy z dnia 11 marca 2022 r. o obronie Ojczyzny (Dz. U. poz. 2305 oraz z 2023 r. poz. 347,641,1615, 1834 i 1872).<\/li><\/ol><p>Ustaw\u0119 stosuje si\u0119 tak\u017ce do wy\u017cej wymienionych os\u00f3b, w przypadku zg\u0142oszenia lub ujawnienia publicznego informacji o naruszeniu prawa uzyskanej w kontek\u015bcie zwi\u0105zanym z prac\u0105, <strong>przed nawi\u0105zaniem<\/strong> stosunku pracy lub innego stosunku prawnego stanowi\u0105cego podstaw\u0119 \u015bwiadczenia pracy lub us\u0142ug lub pe\u0142nienia funkcji w podmiocie prawnym lub na rzecz tego podmiotu, lub pe\u0142nienia s\u0142u\u017cby w podmiocie si\u0119 r\u00f3wnie\u017c do narusze\u0144 prawa w zakresie zam\u00f3wie\u0144 w dziedzinach obronno\u015bci i bezpiecze\u0144stwa w rozumieniu art. 7 pkt 36 ustawy z dnia 11 wrze\u015bnia 2019 r. \u2013 Prawo zam\u00f3wie\u0144 publicznych (Dz. U. z 2023 r. poz. 1605), do kt\u00f3rych nie stosuje si\u0119 przepis\u00f3w tej
